Terms of Service

1. This agreement

These terms are the agreement between you and Quiet Summer LLC ("we", "our", "us") for the Life Tabs mobile app (the "App"). By downloading or using the App you accept them. If you do not accept them, do not use the App.

They sit alongside our Privacy Policy, which explains what we do and do not collect.

2. Who can use Life Tabs

You must be at least 13. If you are under 18 — or under whatever age your country treats as adulthood for this purpose, which is 18 in India and several other countries — you may use the App only with the consent of a parent or guardian, who accepts these terms with you.

There are no accounts. The App is tied to your device, not to an identity we hold.

3. Your content is yours

Your photos, videos and journal entries are yours. We claim no licence over them, no right to use them, and no ownership of them — and this is not a promise we have to police, because they never reach us. They live on your device and in your own iCloud backup.

That also means the responsibility for them is yours. Keep a backup you control. If you delete the App, erase your data, or lose your device, we cannot recover anything, because we never had it.

You are responsible for having the right to store what you store, and for using the App lawfully where you are.

4. Subscriptions and payment

Life Tabs offers auto-renewing subscriptions. The plans, prices and any trial are shown to you before you buy, in your own currency, and those are the terms that apply to your purchase.

• Apple is the seller. Payment is taken by Apple through your App Store account, not by us. We never see your payment details
• Subscriptions renew automatically at the end of each period unless you turn renewal off at least 24 hours before it ends
• You cancel through Apple, in Settings → your name → Subscriptions on your device. Deleting the App does not cancel a subscription, and neither can we
• Price changes are notified by Apple, and Apple will ask you to agree before charging a higher price

5. Free trials and offers

Where a free trial applies, it converts into a paid subscription automatically at the end of the trial unless you cancel before it ends. Cancelling during a trial costs you nothing.

• Standard trials — currently 3 days on the monthly plan and 7 days on the annual plan. Apple allows one introductory offer per subscription group per Apple account, so a trial is not available if you have already used one
• Invited friends — if you enter a friend's invite code before you subscribe, you get a 14-day trial instead of the standard one. The code has to be entered first; we cannot apply it afterwards
• Creator codes — a creator code grants either a free month of access or a year-long free subscription, depending on the code. Each code works once, for one person
• Referral unlock — when three friends subscribe using your invite code, the Auto-Fill feature unlocks for you permanently. Once earned it stays earned, including if those friends later cancel

Offers are for personal use by real people. We may withdraw an offer, refuse a code, or remove a benefit obtained by creating multiple accounts or devices to claim the same offer repeatedly, by automated means, or by any other attempt to work around the one-per-person limits. Where we do that, we will tell you why.

6. Refunds

Because Apple is the seller, refunds are handled by Apple, not by us. We have no ability to issue one. Request a refund at reportaproblem.apple.com.

Any statutory right you have — including the 14-day right of withdrawal for consumers in the EU and the UK — is unaffected by this, and is exercised through Apple in the same way.

7. Using the App properly

You agree not to:

• Use the App for anything unlawful, or to store material you have no right to store
• Reverse engineer, decompile or tamper with the App, except where the law expressly permits it
• Interfere with our servers, attempt to access them without authorisation, or send automated traffic at them
• Resell, sublicense or commercially redistribute access to the App

8. Our rights in the App

The App itself — its software, design, name and artwork — belongs to us and is protected by copyright and trade mark law. We grant you a personal, non-exclusive, non-transferable licence to use it on devices you own or control, for as long as you comply with these terms. That licence gives you no other rights.

9. Changes, availability and ending this agreement

We may change, suspend or discontinue features. If we discontinue something you are paying for, you may cancel your subscription through Apple and, where the law gives you a right to a refund for the unused part, Apple will handle it.

You may stop using the App at any time. We may end this agreement if you materially breach these terms, and we will tell you why unless the law prevents us. Ending it does not delete anything on your device — that has always been yours to remove.

10. Disclaimers

The App is provided "as is". To the extent the law allows, we do not warrant that it will be uninterrupted, error-free or secure, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Life Tabs is a journalling app. It is not a backup service, and it is not a medical, psychological or professional advice service of any kind.

Nothing here removes rights you have as a consumer under the law of your country, including any guarantee that cannot be excluded.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, use or goodwill, arising from your use of the App. Our total liability for any claim will not exceed what you paid us in the twelve months before it arose.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. If any part of this section is unenforceable where you live, the rest still applies.

12. Governing law

These terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules, and the state and federal courts sitting in Wyoming will have jurisdiction.

If you are a consumer, this does not take away the protection of the mandatory law of the country you live in, and it does not stop you bringing proceedings in your local courts where the law gives you that right.

13. Apple App Store terms

These additional terms apply because you obtained the App from Apple's App Store:

• This agreement is between you and Quiet Summer LLC, not Apple. Apple is not responsible for the App or its content
• Apple has no obligation to provide maintenance or support for the App
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. Apple has no other warranty obligation
• Apple is not responsible for addressing any claim you or a third party has relating to the App, including product liability, legal compliance and intellectual property claims
• You confirm you are not located in a country subject to a US Government embargo, and are not on any US Government list of prohibited or restricted parties
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you

14. Changes to these terms

We may update these terms. When we do we will change the date at the top, and where a change materially affects you we will tell you in the App rather than expecting you to notice. If you keep using the App after a change takes effect, you accept it; if you do not want to, you can stop using the App and cancel through Apple.
